By accessing and using the NextTierGrowthCo website and services, you accept and agree to be bound by the terms and provision of this agreement.
NextTierGrowthCo provides digital marketing services including but not limited to website development, ongoing marketing management, and advertising campaign services. We reserve the right to modify or discontinue the service at any time.
Due to the custom nature of our services, all payments are non-refundable. Once a project begins, no refunds will be issued. We are committed to delivering quality work and will address any concerns about the quality of our services.
Upon full payment, clients receive ownership of all custom website elements created specifically for them. NextTierGrowthCo retains ownership of pre-existing templates, frameworks, and general assets. We reserve the right to display completed work in our portfolio.
Clients agree to provide necessary materials, content, and feedback in a timely manner. Delays in client-provided materials may result in project timeline extensions. Clients are responsible for ensuring they have rights to all materials provided.
NextTierGrowthCo agrees to keep all client information confidential. We will not share sensitive business information with third parties without explicit consent.
NextTierGrowthCo shall not be liable for any indirect, incidental, or consequential damages. Our total liability shall not exceed the amount paid by the client for the specific service in question.
Either party may terminate services with 30 days written notice. For monthly marketing services, termination takes effect at the end of the current billing cycle. Clients are responsible for payment of all work completed prior to termination.
These terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these terms shall be resolved through binding arbitration.
