NextTierGrowthCo ("Agency") agrees to provide digital marketing services as outlined in the attached proposal or statement of work. Any additional services outside the defined scope require written approval and may incur additional fees.
All payments are due upfront before services begin. No work will commence until payment is received in full. Payment methods accepted: Bank transfer, Credit card, PayPal.
All payments are non-refundable once services begin. Due to the nature of digital marketing and creative services, once work has commenced, no refunds will be issued. Client acknowledges that they are paying for time and resources allocated to their project.
Agency does not guarantee specific results, rankings, traffic levels, or revenue increases. Marketing outcomes depend on many factors including market conditions, competition, client industry, and product/service quality. Agency will use industry best practices but cannot guarantee specific outcomes.
Agency's total liability shall not exceed the total amount paid by Client for services. Agency shall not be liable for any indirect, incidental, consequential, or punitive damages, including lost profits, arising from this agreement.
Upon full payment, Client owns all deliverables created specifically for their project. Agency retains ownership of general templates, frameworks, tools, and pre-existing materials. Client grants Agency permission to use project work for portfolio purposes (unless otherwise agreed in writing).
Both parties agree to keep confidential all proprietary information, trade secrets, and business practices disclosed during the course of this agreement. This obligation survives termination of this agreement.
